I hear many people express concern about those who don't accept the 2020 election, the possibility of the GOP getting a majority of seats in at least one chamber of Congress, candidates running for offices that oversee elections, and other concerns about the US system of government. I even know some people who have looked into getting dual citizenship in another country, "in case."
What I don't hear that much is how to fix the underlying problems. Of course, Democrats want to “get out the vote. “ But the reality is, the GOP would have little chance of controlling the Presidency, House or Senate if our elections weren't biased away from the popular vote / majority will of Americans.
In recent times, when Republicans have held a majority of seats in the Senate, if you added up all the votes nationwide for the 100 Senate seats, you'd find the Republicans got less than 45% of the votes. The two-Senators-per-state rule slants that chamber in favor of low-population states (which tend to be more Republican.)
The last election in which a GOP presidential candidate won the popular vote was 2004 and the time before that was 1988. Not only is the Electoral College an intermediary (which may not quite represent the popular vote,) but each state gets one elector not just for members of the House (proportional to population) but also for each Senator (not proportional.) In addition to that, states can have a "winner take all" rule for assigning electors, which can also make the Electoral College diverge from the popular vote. This is how Trump "won."
The Presidency and the Senate have these biases against the popular will, and those are the parts of the government in charge of nominating and confirming judges and other non-elected government positions. As a result, our judiciary is biased away from the majority will.
The House is biased by gerrymandering. (Both parties have gerrymandered to some degree, but the GOP to a greater extent.)
The voting for the President, Senate and House are all biased by various election laws. Millions of Americans are prevented from voting because, in the past, they were convicted of a felony - even though they have completed their sentences. Various "red states" have "voter suppression" laws. Beyond that, red states also use voter roll purges, insufficient funding for minority polling sites (resulting in hours-long lines,) closing polling sites (so voters must go further, to unfamiliar areas to vote,) etc.
We're also faced with the problem that Constitutional amendments require 2/3 of the House, 2/3 of the Senate, the President, and 3/4 of the state governments to approve them. So, if the GOP controls 35% of the House, 35% of the Senate, the Presidency, or 30% of state governments, an amendment will fail.
Now, even though the GOP has so many things rigging the system in their favor, they can't count on winning - so they refuse to accept election results unless the results say they won.
On top of that, Jan. 6, 2021 re-emphasized that there are heavily armed far-right groups around the country. And, if "stop the steal" candidates win Secretary of State positions in red states, they may not need an attack on the Capitol to overturn the 2024 election.
Yeah, in theory, it could be possible to get out so many voters to be able to leap over all these barriers in 2024. But, based on what we've been seeing in recent times, if that happens, red states will just try to rig the elections even more in order to win in 2028.
We need more than just a "get out the vote" plan. Perhaps, we might not need it. But it's wise to have a Plan B. It's wise to have health insurance, even if you're currently healthy. It's wise to put aside money "for a rainy day." It's wise to lock the door to your home, even if you haven't heard about burglaries in your neighborhood...
We can try court cases. But as we know, the GOP-controlled Senate denied numerous Obama nominations, and then rammed through so many under Trump. Yes, the court system is not entirely under the GOP's control. Most courts rejected Trump's cases against the 2020 election. However, the courts ARE disproportionately filled by Republicans - with many judges recommended by the Federalists. If Republicans re-take the Senate, they may deny any further Biden nominees. And all Hell could break loose if Republican rigging lets them get the Presidency in 2024. I'm not saying what WILL happen in the future. I'm saying we should prepare in advance for what is a plausible possibility.
My point is: The current Constitution, the state laws it allows, and currently seated judges make our "through formal systemic channels" options biased against the majority. We need a mass movement which is not limited to channels that diminish majority rule. The mass movement we need isn't just talking to ourselves on social media, or even just talking on radio or TV. We need marches, rallies, boycotts and other actions that aren't diminished by an Electoral College or gerrymandering or voter suppression or stacked courts.
In coming years, our only choices might be living indefinitely in a minority-ruled nation or separating out into a nation that doesn't allow the election biases listed above. And if we reach that point, we'll also need a mass movement for that. We can’t afford to wait until it’s already happened — it will be all that much harder then.
